Liable for contents acc. to § 6 Interstate Agreement on Media Services:
Nonliability / Note on links and external contents
As a content provider (§ 5 para. 1 Interstate Agreement on Media Services), the SIGOS GmbH is responsible by law for “own content” that it provides. Contents provided by SIGOS GmbH have to be distinguished from links to contents on external sites.
SIGOS GmbH is not responsible for any contents linked or referred to from its pages unless it has full knowledge of their illegal nature and is able to prevent visitors of this site from viewing those pages as far as it is technically feasible and within the borders of what is reasonable (§ 5 para. 2 Interstate Agreement on Media Services).
Links, however, are always “dynamic” references that may change. SIGOS GmbH has examined the links for contents that may violate penal or civil law the first time the links were established. However, SIGOS GmbH is not obligated to constantly check links for changes that may violate the law. In case SIGOS GmbH discovers or is pointed to contents that violate the law, the relevant links are deleted as far as it is technically feasible and within the borders of what is reasonable. Technical feasibility is not influenced by the fact that even after preventing access from www.sigos.com and sites associated with it, it is still possible to access illegal or criminal contents from other servers.
